The Terms of Use apply to the Murmur ( " Murmur " ) application, which is a product of Solstice Technology Co., Ltd. Your use of this application constitutes your agreement to these Terms of Use; if you do not agree, please do not use this application.

To the extent permitted by law, Murmur reserves the right to change the contents of these Terms of Use at any time at its sole discretion. You are responsible for regularly checking the changes to these Terms of Use. Your continued use of this application after the change information is posted will constitute your agreement and acceptance of the change.

Murmur can be accessible worldwide, not all features, products or services discussed, mentioned, provided or offered through or on this App are available to all persons or in all geographic locations. And it is your own decision and you are responsible for complying with applicable local laws.

All texts, pictures, music, videos, animations, trademarks, patterns, graphics, visual interfaces and computer codes ( " Content " ) contained in this application, including but not limited to the creativity, design, structure, expression, presentation results, etc. of the Content, are owned by Murmur, controlled by Murmur or used with legal authorization by Murmur. Unless expressly provided in these Terms of Use, you may not use the content of this application in any way for any commercial purpose without the prior written consent of Murmur.

You may download information about Murmur products and services provided by Murmur from this App , provided that:

1.    For personal and non-commercial purposes only;

2.    Do not make any changes to this information;

3.    No further representations and warranties are made with respect to such information and the documents containing such information;

4.    Do not remove any statements or notices indicating Murmur' ownership or other legal rights.

You may not use this application for any illegal purpose or any purpose prohibited by these Terms of Use, and you may not use this application and its content to infringe upon the legitimate rights and interests of other organizations or individuals.

You may not use any form of device, program, algorithm, including spider , robot , deep-link , page-scrape , or any identical or similar manual process to access, obtain, copy or monitor any part or any content of this Application, nor may you access, obtain or copy any materials, files or information of this Application by any means not provided by this Application.

You may not attempt to gain unauthorized access to any content or use any service of this application by illegal intrusion, password cracking or any other illegal means. You may not trace, reverse lookup, crack or decipher the information of any customer of this application, including but not limited to any account of this application that is not owned by you.

You may not violate any network security mechanisms or authentication measures of this application or any network linked to this application, you may not detect, scan or test any network vulnerabilities of this application or any network connected to this application, and you may not launch any form of network attacks on this application.

You agree not to use any device, software or routine to interfere or attempt to interfere with the normal operation of the App or any transaction conducted on the App, or interfere or attempt to interfere with the use of the App by others. You may not take any action to store an unreasonable or disproportionate amount of data on the App's infrastructure, systems or networks, or on systems or networks connected to the App.

5. Fees and Subscriptions

Free User Limitations: As a non-paying user of the Murmur application, you are entitled to create a maximum of three (3) AI companions, and ten (10) free conversation rounds per day.

Subscription Services: To enjoy the full benefits of Murmur, including unlimited creation of AI companions and unrestricted conversations with your own or others' AI companions, you may opt for our Standard Membership subscription service.

Subscription Plans: Our Standard Membership is available on a weekly, monthly, or annual basis. The subscription fees are as follows:

Annual Subscription: $99.99 per year

Monthly Subscription: $9.99 per month

Weekly Subscription: $2.99 per week

Subscription Benefits: By subscribing to our Standard Membership, you will gain access to:

Unlimited creation of AI companions.

Unlimited conversations with any AI companion.

Payment and Renewal: Subscription fees will be charged to your apple account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period, and the cost of the renewal will be the same as the original subscription fee, unless otherwise stated.

Cancellation, Changes and Refunds: All are subject to IOS in-app purchase agreement

This application may contain links to other independent third-party websites, which are provided only for the convenience of visitors to this application. Murmur does not provide any express or implied guarantee for the content, services, information, etc. of the linked websites, and such links are not considered as Murmur' recommendation or authorization of the linked websites. You need to independently judge your interaction with the linked websites, and Murmur does not assume any responsibility for this.

Murmur' privacy policy applies to the use of this app.

It must be reminded that the network connection and data transmission between you and this application are not completely secure or confidential. The information and data you send to this application may be intercepted by others. Murmur cannot guarantee the security and confidentiality of the network connection and data transmission between you and this application.

Murmur reserves the right to do the following at any time without notice:

1.    Suspend or terminate the operation and access of all or part of this application for any reason;

2.    Modify or change all or part of the content of this application and its applicable policies or terms;

3.    Interrupt operation of and access to all or part of the Application as necessary to perform scheduled or unscheduled maintenance, error correction or other changes.

Murmur does not make any guarantee of any kind regarding the availability, continuity, and accessibility of this application and its content and services. This application and its content are provided on an " as is " basis . You are solely responsible for your use of this application and any linked website. If you are dissatisfied with all or part of this application, your only remedy is to stop using all or part of this application. Remedy limitations are part of your agreement with Murmur.

Murmur be liable for any indirect, consequential, disciplinary, incidental or punitive damages, including but not limited to loss of profits, suffered by the user due to the use of this application, even if Murmur has been informed of the possibility of such damages.

Murmur and its partners' total and maximum liability to you for any damage or loss arising from your use of this application shall not exceed the total amount of subscription fees or similar fees related to your use of any service or feature of this application.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO THE FOREGOING LIMITATION MAY NOT APPLY TO YOU.

11.                Compensation

Murmur and its directors, officers, employees, agents, partners, agents and licensors from any demands, loss, liability, claims or expenses (including attorneys' fees) made against Murmur by any third party arising out of or in connection with your use of the App.

" Limitation of Liability " and Article 10 " Indemnification " of this Agreement shall take effect independently, even if they are deemed to fail to achieve their basic purpose or cannot be enforced according to law. To the extent permitted by relevant effective laws, the legal liability limitations of Articles 9 and 10 shall apply, regardless of whether the cause of the loss is:

1.    Breach of contract;

2.    breach of warranty;

3.    Fault or tort, including negligence and misrepresentation;

4.    Strict liability;

5.    Any other reason.

Any feedback you provide on this application will be deemed non-confidential, and Murmur may use such information at any time without restriction.

You agree that if Murmur believes that you have violated these Terms of Use, Murmur may, at its sole discretion and without prior notice, terminate your access to the App and / or prevent you from accessing the App.

Murmur shall not be liable to you or any third party for any termination of your access to this App due to any violation of these Terms of Use .

You agree that Murmur may, at its sole discretion and without prior notice, terminate your access to all or part of the features of this App for the following reasons, including (but not limited to):

·        At the request of law enforcement or other government agencies;

·        At your request;

·        any discontinuation or material modification of the App or any services provided by the App;

·        Unexpected technical problems.

These Terms of Use constitute the entire agreement between you and Murmur regarding your use of this App, and supersede any and all previously existing written or oral agreements between you and Murmur regarding the use of this App. Except as provided in other agreements between you and Murmur, Murmur does not accept any counter-offers to these Terms of Use, and hereby expressly rejects all counter-offers.

If Murmur fails to insist on or enforce strict performance of these Terms of Use, it shall not be deemed a waiver of any content of these Terms of Use or any right to enforce these Terms of Use, and any conduct between Murmur and you or any other third party shall not be deemed a modification of any provision of these Terms of Use.
